A homeowner walked into a bedroom to find his tenant — a convicted sex offender — lying half-dressed on top of a girl, Florida deputies said.

Daniel D’Angelo, 53, is now charged with lewd and lascivious conduct and failure to register as a sex offender, Charlotte County court records show.

Records show D’Angelo was previously convicted of a sex offense involving a 4-year-old child out of state in 2002.

D’Angelo signed an agreement to rent a bedroom at the home in Port Charlotte about two weeks before the Aug. 17 incident, deputies with the Charlotte County Sheriff’s Office wrote in a probable cause affidavit.

That night, the homeowner said he had been doing work around the house when he “suddenly got a bad feeling” and decided to check on the young girl in one of the bedrooms, investigators said.

The affidavit is redacted, so the relationship between the child and the homeowner is unclear. The sheriff’s office said it could not clarify redacted information.

When he walked in, he recounted finding D’Angelo shirtless with his pants around his ankles, lying on top of the child in her bed with one hand on her leg, deputies said.

The man said he “grabbed D’Angelo and the two men struggled about the bedroom,” until the homeowner decided to let go and take a photo of D’Angelo, according to investigators.

One photo viewed by deputies showed D’Angelo shirtless and pulling his jeans up while the child is seen lying in bed, according to the affidavit.

Investigators said they spoke with the child, and she told them she was sleeping when she woke up to D’Angelo on top of her without his shirt on. She said he touched her leg and put his fingers in her ear before the homeowner walked in, according to the affidavit.

D’Angelo told deputies he had never been in the child’s bedroom, and the photo showing him shirtless wasn’t of him and was probably “off of the internet,” investigators said. When confronted by the men’s shirt found in the child’s bedroom, D’Angelo said it was planted, according to deputies.

The rental agreement showed D’Angelo moved in Aug. 1 but hadn’t updated his sex offender registration at the new address, investigators said. A search by officials also found prior arrests over failure to update his registration, according to the affidavit.

D’Angelo also said he had three beers that day, including one right before the incident, according to deputies.

Port Charlotte is about a 35-mile drive northwest from Fort Myers.
