A Texas woman is suing a U.S. Marine after she says she became pregnant by him and he drugged her with an abortion pill, killing her unborn baby.

McClatchy News is not naming the man since he has not been criminally charged. Attorney information for him was not available.

The man and woman lived next door to each other in Corpus Christi, according to a civil complaint.

On Feb. 4, the woman learned she was pregnant and planned to have the baby and raise it alongside her three other children, the lawsuit said. However, the man was unhappy about the pregnancy and wanted her to terminate it, according to the complaint.

On Feb. 5, the man told the woman he was going to buy abortion pills despite her objections, the lawsuit said. However, the next day he texted her saying he found them, according to the complaint.

Between Feb. 3 and April 1, the man repeatedly tried to convince the woman to get an abortion, the lawsuit said. Text messages showed he told her “If that thing ever gets born it will be a failure on multiple levels” and “I only want to abort this monstrosity of a situation,” according to the lawsuit.

Then, on April 2, the man texted the woman and asked if she wanted to hang out for a “trust building night” and he would “make us some warm relaxing tea,” the lawsuit said.

The woman agreed, thinking the meeting “could salvage something from a bad situation” and was a “last-ditch opportunity to get on reasonable terms with the father of her daughter,” the complaint said.

While at the woman’s apartment, the man made hot chocolate for her, but he laced it with an abortion pill, according to the lawsuit.

Within 30 minutes of drinking it, she began hemorrhaging and cramping, the complaint said.

The man said he would go pick up the woman’s mother to stay with her children so he could take her to a hospital, but the man left, never picked her mom up and never came back, the lawsuit said.

The woman called him repeatedly but he ignored her calls and texts, according to the complaint. He eventually texted her back saying he would not be returning to help her because he had a flight the next day, the complaint said.

The woman’s mother took an Uber to her house and a neighbor drove her to a hospital. She was told the unborn baby died, the lawsuit said.

Before she went to the hospital, the woman noticed a pill bottle with 10 missing misoprostol pills and an opened box of mifepristone, both abortion pills, at her apartment, the lawsuit said. The woman took the containers with her to the emergency room and gave them to police, the complaint said.

A detective investigated and sent their findings to the Nueces County District Attorney’s Office, according to The New York Times.

“After careful review, both agencies concluded that the elements of a crime could not be established, and the investigation was subsequently closed as unfounded,” Madeline Vaughn, a spokeswoman with the department, told the news outlet in a statement.

The woman is suing for wrongful death and is asking for an undetermined amount in damages.
