Cop stalks teen Starbucks worker, Texas police say. ‘You turn 18 in three weeks’

A deputy was recently arrested after being accused of sexually harassing a teenage Starbucks employee, according to Texas officials.

Ostin Urbina, a 41-year old deputy with the Harris County Precinct 7 Constable’s Office, is facing a charge of official oppression, court records filed Aug. 30 show.

Urbina’s attorney, Nicholas Poehl, said the deputy is innocent, adding “we look forward to litigating the issue in court.”

Officers with the Houston Police Department began investigating Urbina shortly after a series of alleged incidents in August 2023, in which the then-teenage barista said Urbina abused his privileges as a deputy to harass and stalk her, according to a probable cause affidavit.

The barista was at work when the harassment started, she told investigators. On Aug. 24, 2023, she had a brief conversation with Urbina, who was a regular at the Starbucks location, and he asked for her name. When she told him, Urbina said he was going to look her up “in the (police) system,” documents read.

At the end of her shift, she discovered Urbina had been true to his word, she told investigators. According to the affidavit, she found Urbina was waiting outside, parked beside her car in his patrol vehicle, and mentioned her home address.

Urbina said he figured out where she lived by looking up the license plates of every vehicle in the parking lot until he ran hers, the barista told investigators.

“She reported telling him it was strange and he should stop stalking her,” the affidavit read, but Urbina “persisted,” asking her if she had a boyfriend and if she wanted “someone to have fun with.”

He told her, “I’m going to be waiting for you on that street,” according to the affidavit.

The encounter made her uneasy, so she went back into the Starbucks to tell co-workers what happened and to wait for Urbina to leave, investigators said.

Later, as the teen was driving home, a police car turned on its sirens behind her and pulled her over. It was deputy Urbina, the affidavit said.

He talked to her about his marriage, which he had previously mentioned wouldn’t get in the way, and asked for her Snapchat, according to investigators. “She changed the subject” and, a few moments later, she told him she had to go. As he left, Urbina said “just remember you turn 18 in three weeks,” the affidavit read.

She told investigators Urbina pulled her over a second time, in a different location, on Aug. 31, and he asked her if she wanted to hang out at a nearby park. She said no, and asked Urbina why his body camera was turned off, and he responded “it wasn’t necessary … he was just trying to find a way to talk to her.”

Police launched an investigation into Urbina the next day, Sept. 1, 2023.

Investigators learned that Urbina had looked up the teen’s license plate on Aug. 24, according to state Department of Public Safety records. Additionally, a portion of surveillance video taken that day from the Starbucks and a nearby business “precisely matches (the teen’s) description,” investigators said.

Two witnesses also corroborated the barista’s account, according to the affidavit.

Precinct 7 officials said they are aware of the allegations against Urbina, KPRC reported, citing a statement from the precinct.

“Upon learning of these misdemeanor charges being filed, Sergeant Urbina was arrested by Precinct Seven Commanders, immediately relieved of duty, and placed on administrative leave by Constable Phillips as department protocol,” it read, adding that Urbina joined the precinct in 2017.
