A man is accused of attacking an 8-year-old girl with a beer bottle at a restaurant in New Mexico, officials said.

Nichalas San Souci, 24, was indicted in connection with abuse of a child resulting in great bodily harm, aggravated battery (deadly weapon), and aggravated assault (deadly weapon), the Bernalillo County District Attorney’s Office said in a May 16 post on Facebook.

His attorney, Graham F. Dumas, said in a May 16 email to McClatchy News that, “this case is in its earliest stages, and the defense has not had an opportunity to fully investigate the allegations against Mr. San Souci.”

Dumas added that San Souci plans to plead not guilty during an arraignment hearing May 19 and said “it is critical to remember that, under both the federal and the state constitution, Mr. San Souci is innocent and entitled to due process of law. He will remain innocent unless the prosecution proves otherwise beyond a reasonable doubt to the satisfaction of a jury.”

The girl required 19 stitches after the April 25 incident, prosecutors said.

She “was looking at a waterfall inside an Albuquerque restaurant when San Souci hit (her) over the head with a beer bottle, then sliced her neck with the broken bottle,” according to prosecutors, who said the girl didn’t know San Souci.
