Palmetto police: Fired Domino's employee threatens supervisor with gun

PALMETTO -- A 21-year-old Palmetto man has been charged with aggravated assault and improperly exhibiting a firearm after he displayed a pistol to an employer who fired him and refused to leave his former work's property Monday night, according to the Palmetto Police Department.

Davion Swilley came to the Domino's at 1022 Eighth Ave. W. in Palmetto at 11:30 p.m. and asked his supervisor if he still had a job there, and the victim said he was no longer needed, according to an arrest report. Swilley left but came back moments later to toss his uniform at his former supervisor, and the victim noticed Swilley had a pistol tucked in his waistband.

Swilley started to yell and curse at the victim but eventually left the interior of the restaurant, all while still exhibiting the firearm, police said. The victim said he was afraid Swilley was going to shoot him and locked the doors. Swilley sat in his car outside the Domino's for about an hour before the victim decided to call police.

When Swilley saw the officers he started to drive away, so law enforcement conducted a traffic stop a couple of blocks away. Swilley was ordered to show his hands but would only show one hand at a time, and when he eventually showed both hands he had his middle finger raised at police, according to the report.

He also shouted, "Shoot me, crackers, I don't give a (expletive), shoot me," according to the report.

A loaded firearm with additional ammunition was located in the vehicle after Swilley was detained. Swilley said after he was arrested multiple times he had a concealed weapons permit, but police could not find him on any database.

Swilley was charged with aggravated assault, improperly exhibiting a firearm and resisting officers without violence. He is being held in the Manatee County jail on bonds totaling $40,500.
