Deputies used electronic control devices to arrest man at a gym
Two deputies used their electronic control devices to arrest a man they believed to be a registered sex offender who hadn’t updated his address after moving from out of state.
A probation officer in Deschutes County, Oregon, told Manatee County Sheriff’s Office officials about Edwin R. Montee in March, who the officer believed was living in Manatee County.
Montee, 22, a registered sex offender in Oregon, left the state near the end of March and failed to check out with probation, according to a probable cause affidavit. Manatee County Sheriff’s Office deputies went to an address the probation officer provided, but found the apartment empty.
On May 28, deputies took a domestic disturbance report involving Montee, but he was gone by the time deputies arrived, the affidavit stated.
On June 14, a detective noted to investigators that Montee frequents a gym on Cortez Road. The next day, officials were notified that Montee was there, according to the affidavit.
Deputies went to the gym where they saw Montee working out and approached him. When asked for his name, Montee allegedly provided a false name. Deputies confirmed it was Montee using a photo, and told him he was under arrest, according to the affidavit.
Montee ran toward the front door while deputies yelled “Taser” and ordered him to stop.
When Montee tried to leave through the front doors, both deputies deployed their electronic control devices, both hitting Montee, according to the affidavit.
He was transported to the hospital for observation and later taken to jail, according to sheriff’s office spokesperson Dave Bristow.
Montee was charged with failure to register as a sex offender, a felony, resisting arrest without violence and giving a false name, both misdemeanors.
