Delmer Smith sentenced to life in prison for Sarasota home invasion and kidnap

SARASOTA -- Delmer Smith III was sentenced to life in prison without parole on Wednesday for an armed home invasion and kidnapping Sarasota case he was found guilty in earlier this month.

During the sentencing hearing, Smith, garbed in a yellow jump suit and brown sandals, told the court that the trial was not fair because many factors had been left out, including the victim's 911 call where she described the suspect as a black male and the deputies who refused to turn in his DNA.

"I am innocent of all these charges," Smith said.

Smith has 30 days to make an appeal.

Earlier this month, Smith was found guilty in the armed home invasion at a Sarasota home where he robbed an elderly woman and tied her up with electrical cords.

Smith will also go to trial in July in Manatee, where is charged with murdering Kathleen Briles in her Terra Ceia home in 2009. That trial is set for July. He faces the death penalty.
