Manatee woman charged with manslaughter in her baby's death

MANATEE -- Deputies arrested a woman Tuesday in connection with the 2010 death of her daughter.

Windy Nash, 21, is charged with aggravated manslaughter of a child.

Eleven-month-old Payton Nash Moistner died Sept. 14, 2010, due to a head injury. Autopsy results showed the child died of a fractured skull and bleeding in the brain.

Nash's boyfriend, John Morico, 20, was arrested soon after and charged with killing the child. He is serving a 10-year sentence for manslaughter.

Two days before Moistner's death, Morico tripped and fell onto the child while holding her. The incident took place in a trailer on the 3700 block of Manatee Avenue West.

An investigation following Moistner's death found five incidents of abuse over approximately the two weeks before she died, states a Manatee County sheriff's office news release.

In the days leading to her death, a stroller fell on the baby's head while she was in Morico's care; a functioning chair fell on the child's head; the baby fell into the bathtub and hit her head while in Nash's care; and Morico punched a door which struck the child standing on the other side, according to the sheriff's office.

"Nash failed to protect the child from continued abuse," the release states.

After a lengthy investigation, deputies went to Indiana where Nash had relocated. She returned to Manatee County on Tuesday, said Dave Bristow, spokesman for the sheriff's office.

"We arrested the other guy right away because he was the one doing the abuse," Bristow said. "What she did was not get any help or protect this child from him."

Bristow said Nash was pursued as soon as deputies were able to obtain an arrest warrant. The warrant was issued on April 20.

Nash is being held without bond at the Manatee County jail.
