Negligence suit filed against Manatee school board and employee

MANATEE — A Palmetto mother is suing the Manatee County School Board and a teacher after the teacher reportedly injured the woman’s autistic son.

Plaintiff Fredia Vining claims her son’s elbow was fractured by the teacher at lunchtime on Feb. 4, 2008, at Palmetto Elementary School, according to a 15-page lawsuit filed this week in Bradenton.

According to Vining, teacher Barbara Ryan grabbed her son’s arm with “unreasonable force” when he was trying to throw his lunch tray away and caused food to spill.

As the teacher held onto the boy’s arm tightly, the suit alleges, it fractured.

The suit is seeking damages in excess of $15,000.

School Board Attorney John Bowen this morning said the district had not yet been served with the suit.
