MANATEE -- Murder charges have been re- filed against a 31-year-old man for a 2009 home invasion that left a pregnant woman and her child dead, according to the Manatee County Sheriff's Office.
Everrick Houston had originally been charged with murder after the July 12, 2009, shooting at the Desoto Village Apartments, 3810 Fifth St. E.
Crystal Johnson was killed, and her unborn child died later at a St. Petersburg hospital.
Charges against Houston, who was injured during a shootout that ensued after the home invasion, were dropped after a judge ruled that Manatee County Sheriff’s Office deputies illegally took his DNA from his bloodied clothes at Manatee Memorial Hospital.
"Detectives were able to gather additional evidence connecting Houston to the crime scene and he was indicted in April 2013," the release states.
At the time of his first arrest, Houston was facing federal drug charges, for which he was convicted and sentenced to prison, according to the sheriff's office.
He was transported to the Manatee County jail this week to face two murder charges, as well as a charge of armed burglary.
A second defendant in the case, Gregory Kennon, was convicted on two counts of murder in 2012 and sentenced to life in prison.
