ANNA MARIA — When City of Anna Maria voters go to the polls today for a re- call election, they will be asked to use a No. 2 pencil to fill in two ovals of their choice:
n Shall Harry Stoltzfus be removed from office of Anna Maria city commission by recall?
n City commission (vote for one): Eugene E. Aubry or Harry Stoltzfus.
Contacted at home Monday about what kind of voter turnout she expects today, Mayor Fran Barford said, “I have no idea, it’s such an odd situation.”
Never miss a local story.
Polls will be open from 7 a.m. to 7 p.m. at Precinct 91, Roser Memorial Com- munity Church, 512 Pine Ave.
A recall petition drive was started after resident Bob Carter read about e-mails Stoltzfus sent to several residents discussing commercial development along Pine Avenue.
The petition statement accused Stoltzfus of malfeasance and misfeasance, alleging the communication violated the Government In The Sunshine Law, and contained libelous and inflammatory remarks, the Herald previously reported.
Results of today’s election will be sealed until at least Sept. 24 to allow Stoltzfus’ appeal of an earlier court case to be heard, Manatee County Circuit Court Judge Edward Nicholas ruled Friday.
If Stoltzfus wins the appeal, the results of the election may never be known. Stoltzfus’ attorney, Richard A. Harrison, told Nicholas that certify- ing the election results be- fore the appeal would cause irreparable harm to his client.
