BRADENTON -- Two women convicted of working as midwives without a license deserve a new trial, the Second District Court of Appeal ruled today.
Linda McGlade and her daughter-in-law Tanya McGlade were found guilty in 2006 and were each sentenced to 2 1/2 years in prison.
The appeals court found that "the jury instruction defining the charged crime was inaccurate. This error compels us to reverse their convictions and sentences and to remand for a new trial."
The McGlades were charged after Mara McGlade, another of Linda's daughter-in-law, died two days after delivering a baby boy at home. The delivery was attended by Linda and Tanya McGlade.
In November 2006, the McGlades were released from prison as their appeal was considered.
