MANATEE -- A judge set bond Tuesday for a Sarasota man charged with molesting two girls.
David Yanuszeski, 57, turned himself into the Manatee County jail at 11:40 p.m. Monday and he was charged with lewd and lascivious molestation and sexual battery.
Yanuszeski appeared before Judge Charles Roberts Tuesday afternoon. Roberts set bonds totaling $150,000.
Defense attorney Scott Rieth spoke on Yanuszeski's behalf.
"There is no physical evidence," Rieth said. "My client adamantly denies these allegations."
Rieth said Yanuszeski was not a flight risk, had limited financial resources and no prior criminal history.
The State Attorney's Office, however, said Yanuszeski had a history dating to the 1980s with arrests for charges of improper display of a firearm, fraud and contempt of court.
The prosecutor also presented evidence Yanuszeski's home is in foreclosure.
Manatee County Sheriff's Office detective James Wischer testified law enforcement had trouble executing the arrest warrant. Investigators arrived at Yanuszeski's home about 5 p.m. Friday to arrest him but only his daughter was home.
"I made contact with him via phone," Wischer said. "He told me he was in Fort Myers and en route from a job there. I told him I would see him in a couple of hours."
Yanuszeski could not be located by deputies for three days, according to Wischer.
Rieth asked the detective if he recalled being informed his client planned to turn himself in Monday.
"Yes, just like so many times before I have heard that," Wis
cher said. "I believe it when I see it myself."
Roberts ordered Yanuszeski placed on supervised release with no contact with any alleged victims, their families or other minors if he is released on bond.
The victims are 7 and 15 years old, respectively, according to Manatee County Sheriff's Office.
"The victims are known to the suspect," sheriff's office spokesman Dave Bristow said.
Yanuszeski was arrested in 2011 for allegations involving the now-15-year-old, but the State Attorney's Office declined to prosecute, Bristow said.
"However, with this case, it's similar facts," Bristow said. "Each case helps the other."
Investigators were alerted to the recent allegations May 7 when the girl told her parents she had been molested, according to Bristow.
Yanuszeski remains in custody at the Manatee County jail.
