False receipt ploy fails at Manatee Home Depot

HERALD STAFF REPORTFebruary 21, 2014

Nicholas Kelly

MANATEE -- Nicholas Kelly allegedly walked in the Home Depot at 2350 Cortez Road at 10:10 a.m. Thursday with no items in his hands.

But he was seen on store surveillance video removing a receipt from his pocket and picking items in the store that matched the product code numbers on the items, according to a Manatee County Sheriff's Office report.

Kelly, a Bradenton resident, then gathered four items in the Home Depot and took the items to customer service, the report states.

Kelly showed the receipt and requested a refund of $73.69 for the items, the report states.

After he was handed the money, Kelly was stopped by a Home Depot loss prevention officer.

He was arrested and charged with making a fraudulent request for a refund with a false receipt, the report states.

It was later discovered that the receipt Kelly brought into the store matched the one from another customer, according to the report.

Kelly remained in the Manatee County jail Friday subject to a $120 bond, according to the sheriff's office website.
